Appeals Court Upholds Trump’s Authority to Halt Refugee Resettlement in U.S.

In their decision, the panel of judges stated, “The panel concluded that Plaintiffs failed to make a strong showing that they are likely to succeed on the merits of their challenges to Executive Order No. 14163 as beyond the President’s statutory authority under 8 U.S.C. § 1182(f) and the Refugee Act.” They clarified that the President has the power to suspend approved refugees’ admission to the United States. Additionally, the panel dismissed the district court’s concerns regarding the President’s suspension of all applications for refugee status, emphasizing that the Refugee Act does not oblige the President to continue processing applications when admissions have been suspended.
Dale Wilcox, representing the Federation for American Immigration Reform (FAIR), praised the court’s decision, particularly since his organization had supported Trump’s authority to halt refugee resettlement. Wilcox emphasized that the acceptance of refugees is a matter of policy, not law, and that the President is entitled to block their entry if he deems it appropriate. The court’s recognition of the President’s prerogative and the vacating of the lower court’s injunction was seen as a victory by Wilcox and FAIR.
