Judge denies Marilyn Manson’s motion to dismiss sexual assault lawsuit.
A recent ruling in California saw Marilyn Manson’s motion to dismiss a sexual assault lawsuit filed by his former personal assistant, Ashley Walters, denied by a judge. This decision marks a continuation of the legal battle that has seen the case dismissed twice before by the courts.
Walters initially brought the lawsuit against the rock star in 2021, alleging sexual assault, harassment, battery, and emotional distress stemming from incidents that occurred in 2010 and 2011. However, the case was dismissed in May 2022 due to what the judge deemed insufficient information provided by Walters and the expiration of California’s statute of limitations. Despite making modifications to her case in December 2023, Walters faced another dismissal in December 2025 for the same timing issue.
Undeterred, Walters pursued legal action once more in January, this time employing AB 250, a new California law that allows adult survivors of sexual abuse to revive old cases that surpass the deadline. Manson’s attorney, Alexa Foley, contended during the hearing that Walters had not demonstrated that she was physically restrained during the alleged assault, suggesting that AB 250 did not apply in her situation. However, the judge disagreed with this argument.
Howard King, another attorney representing Manson, acknowledged that the judge’s ruling was anticipated. He indicated that it signaled a forthcoming summary judgment motion in the case. Walters’ representative, Bina Ahmad, expressed satisfaction with the judge’s decision and highlighted her client’s courage as a source of inspiration to continue the legal battle.
Manson, whose real name is Brian Warner, maintains that the accusations against him are false as he faces multiple civil cases. A conference to further examine Walters’ case is scheduled for August, where the legal proceedings will continue. The outcome of this ongoing legal dispute remains to be seen as both parties remain steadfast in their positions.
