Former Cradle Of Filth Members File Lawsuit Against Frontman Dani Filth

Cradle Of Filth has experienced a turbulent few months as former band members Marek “Ashok” Šmerda and Zoe Federoff decided to depart from the extreme metal group in August. The reasons cited for their departure included what they described as “foolish clown antics” by lead singer Dani Filth, unprofessional behavior from manager Dez Fafara, a toxic work environment, and problematic session contracts. These allegations were promptly denied by Filth in a detailed statement where he also disclosed personal information about his ex-bandmates. However, he later expressed regret about publicly sharing this information, while maintaining that the accusations of theft and exploitation were untrue.

The situation escalated further when Federoff shared a legal complaint against Cradle Of Filth and their management company Oracle on October 1. The complaint has since been updated to include additional plaintiffs, namely former band members Richard Shaw, Paul Allender, and Lindsay Matheson, as well as model Sasha Baxter, also known as Sasha Massacre, who has appeared in the band’s music videos. The lawsuit alleges unpaid royalties, unauthorized commercial exploitation of the plaintiffs’ likenesses and images on merchandise, and failure to compensate certain former band members for studio time on three of Cradle Of Filth’s recent albums.

Moreover, the lawsuit asserts that Baxter was not adequately compensated for her appearances in music videos or for merchandise featuring her likeness. Matheson also claims that Cradle Of Filth used her sigils without her permission or compensation. The suit also accuses Filth of defamation for insinuating publicly that Federoff consumed alcohol during pregnancy, suggesting that her miscarriage may have been caused by alcohol consumption.

The plaintiffs seek various legal remedies, including an order for the band to stop selling merchandise featuring their likenesses, as well as holding the defendants accountable for copyright infringement, defamation, and unjust enrichment. Additionally, the plaintiffs are pursuing compensatory damages, punitive damages, and reimbursement for attorney’s fees.

In the face of these legal challenges, Cradle Of Filth finds itself embroiled in a complex legal battle that could have significant consequences for the band’s future and reputation. The outcome of this dispute remains uncertain as the legal process unfolds, and the allegations and counterclaims continue to be contested.
