West Wickham KFC franchise owner fined £70k for ‘slave’ remark

A KFC franchisee in south-east London has been fined nearly £70,000 after a manager made derogatory comments towards an Indian worker and subjected him to unfair treatment, a tribunal revealed.

Madhesh Ravichandran, who hails from the Indian state of Tamil Nadu, joined the West Wickham KFC branch as an employee in January 2023. However, just two months into his employment, Mr. Ravichandran was denied his annual leave request and overheard his boss, Kajan Theiventhiram, making discriminatory remarks about him, referring to him as a “slave” in a conversation with a colleague.

Upon investigation, tribunal judge Paul Abbott determined that Mr. Ravichandran was wrongfully terminated from his job and had been a victim of direct race discrimination, racial harassment, and victimization in the workplace. Despite the distressing comments made by his manager, no substantial inquiry was conducted into the allegations raised by Mr. Ravichandran.

Following the incident, Mr. Ravichandran decided to resign from his position. The judge noted that the denial of his leave request was heavily influenced by his race, causing the claimant to feel “upset and humiliated” by the situation.

Judge Abbott further acknowledged that Mr. Theiventhiram’s discriminatory behavior extended beyond verbal abuse, as he exhibited a clear bias towards the claimant by forcing him to work excessively long hours due to his prejudiced views.

In light of the findings, Mr. Ravichandran was awarded £66,800 in compensation. In addition to the monetary reparation, the tribunal also recommended that Nexus Foods Limited, the operator of the West Wickham KFC branch, implement a comprehensive training program for all employees aimed at addressing and preventing discrimination in the workplace.

The outcome of this tribunal case serves as a stark reminder of the importance of fostering an inclusive and respectful work environment. Discriminatory behavior, such as that displayed by Mr. Theiventhiram towards Mr. Ravichandran, has no place in any professional setting and must be swiftly addressed and rectified.

This incident underscores the need for businesses to prioritize diversity and inclusion initiatives and to ensure that all employees are treated with dignity and respect, regardless of their race, ethnicity, or background.
